Product Use, Safety & Assumption of Responsibility

Kace’s Way products are designed and sold as sensory support tools and are intended to be used only for their stated purpose and in accordance with the product-specific safety information provided with each product and on the Kace’s Way website.

Purchasers and users are responsible for reviewing all product information and safety instructions before use. Because Kace’s Way products are intended for use by children and other individuals who may require supervision, the purchaser, parent, caregiver, educator, therapist, church, organization, or other supervising adult is responsible for determining whether a product is appropriate for the individual user and for providing appropriate supervision based on the user's age, abilities, behavior, and circumstances.

The Kace’s Way Signature Sensory Bottle is approximately 1 lb and may be heavier than many standard sensory bottles. It should not be thrown, dropped intentionally, struck against objects or people, or used in a manner inconsistent with its intended sensory purpose. The purchaser and supervising adult are responsible for taking reasonable precautions to prevent misuse, including throwing, dropping, striking, or other inappropriate use.

Other products in a Kace’s Way sensory kit may contain small components or internal mechanisms and should be used only as intended. Products should not be punctured, cut, opened, modified, disassembled, or otherwise altered.

Purchasers agree to use Kace’s Way products in accordance with the provided safety instructions and acknowledge that inappropriate use, intentional misuse, modification, failure to supervise when supervision is reasonably necessary, or use contrary to the provided instructions may create risks of injury or property damage.

To the fullest extent permitted by applicable law, Kace’s Way is not responsible for injury, damage, or loss arising from misuse, abuse, alteration, modification, or use of a product contrary to the provided instructions or safety information.

Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
